Welcome to Dolce by Tina. These Terms of Use (the “Terms”) explain the rules for using our website at dolcebytina.com (the “Site”) and for ordering our cookies and other products. In these Terms, “Dolce by Tina,” “we,” “us,” and “our” refer to the home-based bakery founded by Tina and operating as a California Cottage Food Operation in Irvine, Orange County, California. “You” refers to anyone who visits the Site or places an order with us.
Please read these Terms carefully. By browsing the Site, placing an order, or signing up for our emails or texts, you agree to these Terms. If you do not agree with them, please do not use the Site or order from us.
Acceptance of These Terms
Using the Site means you accept these Terms as they read at the time of your visit. We may update or change the Terms from time to time as our little bakery grows and evolves. When we do, we will post the updated version here with a new effective date. Continuing to use the Site after we post changes means you accept the updated Terms, so we encourage you to check back now and then.
Who May Use the Site
The Site is intended for people who can form a legally binding contract, generally those who are at least 18 years old. If you are under 18, please use the Site and place orders only with the involvement of a parent or guardian who agrees to these Terms on your behalf. By ordering, you confirm that the information you give us is accurate and that you are allowed to use the payment method you provide.
Our Products
Dolce by Tina bakes fresh cookies in six signature flavors, plus one rotating flavor that changes each month. We also offer gift boxes and gift cards. Because everything is made by hand in small batches, the exact appearance, size, and availability of any item may vary. We do our best to describe and photograph our products accurately, but colors and details you see on your screen may differ slightly from what arrives in the box. We may add, change, or retire flavors and products at any time, and we may limit the quantity available for any order or occasion.
Ordering and Payment
Orders are placed through our online ordering page hosted by Toast at order.toasttab.com/online/dolcebytina. When you submit an order, you are making an offer to buy the items in your cart. Your order is confirmed once payment is completed and you receive confirmation. We reserve the right to decline or cancel any order, for example if an item sells out, if we suspect an error in pricing or description, or if we cannot fulfill the request.
Prices are listed in U.S. dollars and may change at any time before you place an order. Payments are processed by Toast, our third-party ordering and payment provider. When you pay, you are entering into that transaction through Toast’s platform and are subject to their handling of your payment information. Dolce by Tina does not see or store your full card details.
Pickup and Local Delivery
Everything we make is baked to order as a preorder. We currently offer two ways to receive your cookies: pickup in Irvine and local delivery within roughly 25 miles of Irvine. We do not offer nationwide shipping at this time. When you order, please choose your pickup or delivery option and provide accurate contact and address details so we can reach you.
For pickup orders, we will let you know when and where to collect your order. Please pick up your order at the arranged time so it stays fresh. For local delivery, please make sure someone is available to receive the order and that the delivery details you provide are correct. We are not responsible for orders that cannot be delivered because of an incorrect address, an unavailable recipient, or similar issues outside our control.
All Sales Are Final
Because every order is freshly baked just for you, all sales are final. We do not offer refunds, exchanges, or cancellations once an order is placed. If something is wrong with your order, please contact us right away at info@dolcebytina.com or (949) 942-5549 and we will do our best to make it right.
Allergens and Cottage Food Disclosure
Dolce by Tina is a California Cottage Food Operation. This means our products are made in a home kitchen that is not subject to routine state inspection. Our cookies and other items are prepared in a kitchen that handles common allergens, and any product may contain or come into contact with wheat, milk, eggs, soy, peanuts, and tree nuts.
If you have a food allergy or sensitivity, please order thoughtfully and reach out with any questions before you buy. We cannot guarantee that any product is free from a particular allergen. By ordering, you accept responsibility for reviewing this disclosure and deciding whether our products are right for you and anyone you are sharing them with.
Gift Cards
Gift cards may be purchased and redeemed toward eligible products through our ordering page. Gift cards have no cash value except where required by law, cannot be exchanged for cash, and cannot be replaced if lost or stolen. Please treat a gift card like cash. We may set reasonable terms on how and when gift cards can be used, and we will share those details at the time of purchase.
Intellectual Property
The content on our Site, including our name, logo, product names, photos, text, and overall look and feel, belongs to Dolce by Tina or is used with permission, and is protected by copyright, trademark, and other laws. You are welcome to view and enjoy our Site for your own personal, non-commercial use. Please do not copy, reproduce, republish, or use our content, branding, or photos for any other purpose without our written permission.
Acceptable Use
We ask that you use the Site fairly and lawfully. In particular, please do not:
• Provide false, misleading, or fraudulent information when ordering or signing up
• Use the Site for any unlawful purpose or to violate anyone’s rights
• Impersonate another person or misrepresent your connection to anyone
• Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its systems
• Use automated tools to scrape, harvest, or misuse content or customer information
We may limit or block access to the Site if we believe someone is misusing it or breaking these Terms.
Marketing Emails and Texts
If you opt in, we may send you email and text (SMS) marketing about new flavors, seasonal boxes, and updates. Our email and SMS messages are handled through Klaviyo, our third-party marketing provider. Message and data rates may apply to texts, and message frequency varies. You can unsubscribe from emails using the link in any message, and you can opt out of texts by replying STOP. Opting out of marketing will not affect messages we send about an order you have placed.
Third-Party Services
Our Site and business rely on trusted third-party services, including Toast for online ordering and payment, Klaviyo for email and text marketing, and Framer, which hosts our Site. When you use these services through us, you may also be subject to their own terms and privacy practices. We are not responsible for the content, policies, or actions of these third parties, and we encourage you to review their terms directly. Any links on our Site to other websites are provided for convenience only, and we are not responsible for those sites.
Disclaimer of Warranties
The Site and our products are provided on an “as is” and “as available” basis. While we pour a lot of care into everything we bake, we make no warranties of any kind, whether express or implied, about the Site or our products beyond what applicable law requires. We do not promise that the Site will always be available, error-free, or secure.
Limitation of Liability
To the fullest extent allowed by law, Dolce by Tina will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our products. Where liability cannot be excluded, our total responsibility to you for any claim will not exceed the amount you paid for the order that gave rise to the claim. Nothing in these Terms limits any rights you have that cannot be limited under California law.
Changes to These Terms
We may revise these Terms at any time by posting an updated version on this page with a new effective date. Please review the Terms periodically. Your continued use of the Site after changes are posted means you accept them.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or your use of the Site will be handled under California law.
